As we collect and use personal data (hereinafter – the Personal Data), we are obligated to use and process your Personal Data only in accordance with this Privacy Policy (hereinafter – the Privacy Policy), as well as, applicable legislation, including the General Data Protection Regulation (2016/679) (hereinafter – GDPR), the Law on Money Laundering and Terrorist Financing Prevention of the Hong Kong, Law on Legal protection of personal data of the Hong Kong and other applicable legal acts.

Please note that in case you provide us with the information about any person other than yourself, your employees, counterparties, advisers or suppliers, you must ensure that they understand how their information will be used.

This Privacy Policy provides basic rules for collecting, storing, processing and retention of your Personal Data and other information relating to you, as well as, the scope of processed Personal Data, the purposes, sources, recipients and other important aspects of data processing in using our services as an electronic money institution.

We regularly review this Privacy Policy and reserve the right to modify it at any time in accordance with applicable laws and regulations. Any changes and clarifications will take effect immediately on the date on which we post the modified terms on our website: www.peysend.ai.

Principles of processing Personal Data

 

The principles we follow in order to comply with the need to protect your Personal Data are the following:

  1. principle of lawfulness, fairness and transparency’ –your Personal Data is processed lawfully, fairly, honestly and in a transparent manner in relation to the data subject ;
  2. purpose limitation principle’ – your Personal Data is collected for specified, clearly defined, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  3. data minimization principle’ – your Personal Data must be adequate, relevant and limited only to what is necessary in relation to the purposes for which they are processed;
  4. accuracy principle’ – your Personal Data must be accurate and, if necessary, kept up to date; every reasonable step must be taken to ensure that your Personal Data that are inaccurate, having regard to the purposes for which they are processed, are erased or corrected immediately/without delay;
  5. storage limitation principle’ – your Personal Data shall be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the Personal Data are processed;
  6. integrity and confidentiality principle’ – your Personal Data shall be processed in a manner that ensures appropriate security of the Personal Data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

Your Personal Data is considered as confidential information and may only be disclosed to third parties in accordance with the rules and procedure provided in this Privacy Policy and the applicable legal acts.

Please note that in case you provide us with the information about any person other than yourself, your employees, counterparties, advisers or suppliers, you must ensure that they understand how their information will be used.

Types of information we collect about you

 

The categories of Personal Data that we may collect about you are as follows:

  1. Basic Personal Data – name, surname, job title etc.;
  2. Identification information and other background verification Data (your or your representative’s, ultimate beneficiary owner’s of legal entities) – name, surname, ID code, birth date, address, nationality, gender, copy of ID card/passport copy, evidence of beneficial ownership or the source of funds, number of shares held, voting rights or share capital part, title, visually scanned or photographed image of your face or image that you provide through a mobile application or camera, video and audio recordings for identification, telephone conversations to comply with client due diligence/”know your client”/anti-money laundering laws and collected as part of our client acceptance and ongoing monitoring procedures;
  3. Transaction Data – transactional data (e.g. beneficiary details, date, time, amount and currency which was used, name/IP address of sender and receiver), accounts, amount of transactions, income, location, etc.
  4. Information which is related to legal obligations – data resulting from enquiries made by the authorities, data that enables us to perform anti-money laundering requirements and ensure the compliance with international sanctions, including the purpose of the business relationship and whether you are a politically exposed person and other data that is required to be processed by us in order to comply with the legal obligation to “know your client”.
  5. Contact Information – name, postal address, e-mail address and telephone number etc.

Please be informed that other data not listed above that relate to the provision of our services or which you have provided to us may also be collected.

 

Purposes and legal basis for Personal Data processing

 

We use information held about you in the following ways:

1. Conclusion of the contract or for performance of measures at your request prior to the conclusion of the contract (to get to know, identify and verify our clients):

For this purpose we may process your Basic Personal Data, Identification and other background verification Data, Contact Information and other Personal Data (in order to identify the possibility of providing services).

The legal basis for the processing of the above-mentioned data is: concluding a contract with you, fulfilling our legitimate interests and/or fulfilling the legal obligations applicable to us.

2. For the fulfilment of a contract concluded with you, including but not limited to provision of services of issuance, distribution and redemption of electronic money and provision of payment services:

The legal basis for the processing of the above-mentioned data is: performance of a contract signed with you, fulfilling our or third parties’ legitimate interests and/or compliance with legal obligations applicable to us.

3. To comply with legal obligations (e.g. implementation of the obligations under the Law on Money Laundering and Terrorist Financing Prevention of the Republic of Lithuania and other fraud and crime prevention purposes) and risk management obligations):

For this purpose we may process your Basic Personal Data, Identification and other background verification Data, Transaction Data, Information which is related to legal requirements, Contact
Information and other Personal Data provided to us by or on behalf of you or generated by us in the course of providing services. The legal basis for the processing of the above-mentioned data is: fulfilling our or third parties’ legitimate interests and/or compliance with legal obligations applicable to us.

4. To provide an answer when you contact us through our website or other communication measures:

For this purpose we may process your Basic Personal Data, Contact Information and other Personal Data provided to us by or on behalf of you.

The legal basis for the processing of the above-mentioned data is: your consent, fulfilling our or third parties’ legitimate interests.



Facial recognition

 

In order to make your identity verification, we are using the facial recognition solutions provided by iDenfy and Veriff (Identification solution). Please read more about solutions here: https://www.idenfy.com/, https://www.veriff.com/

You will not be asked to complete the Identification solution procedure unless we are required to confirm your identity pursuant to the applicable laws and regulations – for example before a new Paysend Global Transfer account is created for you.

Identification solution is used for comparing live photographic data or video record of yourself and your ID card/passport, to comply with legal obligations (e.g. implementation of the obligations under the Law on Money Laundering and Terrorist Financing Prevention of the Republic of Lithuania and other fraud and crime prevention purposes) and risk management obligations.

The result of the face recognition (match or mismatch) will be retained for as long as it is necessary to carry out identity verification and for the period required by anti-money laundering laws.

We conduct your face recognition using Identification solution on a consent basis. If you do not feel comfortable with this method, you may contact us by email for alternative way to identify yourself.

 

Direct marketing

 

We want to make it clear how we use your Personal Data for marketing purposes.

We may use our existing clients’ e–mail for the marketing of our similar goods or services, unless you object to the use of your e-mail for the marketing of our similar goods and services. You are granted with a clear, free of charge and easily realisable possibility to object or withdraw from such use of your contact details on the occasion of each message.

We may also provide the information to you as our client about our products or services by sending messages through the application. Such messages may be viewed in the notification center, in case you do not choose the “opt-out” function in our application.

In other cases, we may use your Personal Data for the purpose of direct marketing, if you give us your prior consent regarding such use of data.

We are entitled to offer the services provided by our business partners or other third parties to you or make assessments about your opinion on different issues in relation to our business partners or other third parties on the legal basis for this, i.e. on the basis of a prior consent.

In case you do not agree to receive these marketing messages and/or calls offered by us, our business partners or third parties, this will not have any impact on the provision of services to you as the client.

We provide a clear, free-of-charge and easily realisable possibility for you at any time not to give your consent or to withdraw your given consent for sending proposals put forward by us. We shall state in each notification sent by e-mail that you are entitled to object to the processing of the Personal Data or refuse to receive notifications from us. You shall be entitled to refuse to receive notifications from us by clicking on the respective link in each e-mail notification.



Ways of obtaining your Personal Data

 

We obtain personal information from you when you provide it directly to us. For example, when becoming a new client or when you provide us information through direct communication (e.g. completing a form on our website or mobile application, registration for our services), by access and use of our website or mobile application, by setting up an account with us, when you subscribe to our electronic publications (e.g. newsletters).

We also collect personal information about you from third parties, mainly:

  1. when it is provided to us by a third party which is connected to you and/or is dealing with us, for example, business partners, sub–contractors, service providers, merchants and etc.;
  2. third party sources, for example, register held by governmental agencies or where we collect information about you to assist with “know your client” check-ups as part of our client acceptance
    procedures such as sanctions list, politically exposed persons list and etc.;
  3. from banks and/or other finance institutions in case the Personal Data is received while executing payment operations;
  4. from publicly available sources – we may, for example, use sources(such as public websites, open government databases or other data in the public domain) to help us maintain data accuracy,
    provide and enhance our services;
  5. from other entities in the Company Group or other entities which we collaborate with.


Disclosure to and use by third parties

 

We may disclose and/or transfer your Personal Data only in accordance with legal regulations and the principles of confidentiality to the following categories of recipients:

  1. our business partners, agents or intermediaries who are a necessary part of the provision of our products and services;
  2. external service providers that helps us to provide service for you;
  3. third parties where we have a duty to or are permitted to disclose your personal information by law, mainly: governmental bodies and/or supervisory authorities (in accordance with the requirements and obligations under the provisions of legal acts concerning anti-money laundering, fraud prevention, counter terrorist financing), credit, financial, payment and/or other electronic money institutions, pre-trial investigation institutions, the State Tax Inspectorate;
  4. third parties where reasonably required to protect our rights, systems and services, mainly: lawyers, bailiffs, auditors etc.;
  5. service providers such as: cloud storage/servers providers, card issuing institutions (such as Visa or MasterCard), identification and verification service providers, other service providers with
    which we have concluded service provision agreements (e.g. companies providing services for money laundering, politically exposed persons and terrorist financing check-up, other fraud and crime preventions) or when mentioned sharing is mandatory according to applicable laws.
  6. beneficiaries of transaction funds receiving the information in payment statements together with the funds of the transaction;
  7. other entities that have a legitimate interest or the Personal Data may be shared with them under the contract which is concluded between you and the Company;

We may also disclose your Personal Data, if we are under a duty to disclose or share your personal information in order to comply with any legal or regulatory obligation or request.



International transfers of your Personal Data

 

As we provide international services, your Personal Data may be transferred and processed outside the European Union (hereinafter – the EU) and the European Economic Area (hereinafter – the EEA).

The transfer of Personal Data may be considered as needed in such situations as, e.g.:

  1. in order to conclude the agreement between you and the Company and/or in order to fulfill the obligations which are set under such agreement;
  2. in cases indicated in legal acts and regulations for protection of our lawful interests, e.g. in order to file a lawsuit in court/other governmental bodies;
  3. in order to fulfill legal requirements or in order to realize public interest.

When we transfer your Personal Data internationally, we put in place safeguards in accordance with applicable laws and in accordance with this Privacy Policy and we will ensure that it is protected and transferred in a consistent way with the legal requirements applicable to the Personal Data.

There are different ways to ensure that your Personal Data is treated securely, mainly:

  1. the country to which we send the Personal Data, a territory or one or more specified sectors within that third country, or the international organization is approved by the European Commission as having a satisfactory level of protection;
  2. the recipient has signed standard data protection clauses which are approved by the European Commission;
  3. if the recipient is located in the US and is a certified member of the EU–US Privacy Shield scheme;
  4. in case a special permission has been obtained from a supervisory authority.

We may transfer Personal Data to a third country by taking other measures if it ensures appropriate safeguards as indicated in the GDPR.



Automated decision-making

 

In some cases, we may use automated decision-making which refers to a decision which is taken solely on the basis of automated processing of your Personal Data.

Automated decision-making refers to the processing using, for example, a software code or an algorithm, which does not require human intervention.

We may use forms of automated decision-making on processing your Personal Data for some services and products. When using automated decision-making we will provide you with further information about the logic involved, as well as the significance and the envisaged consequences to you.

Please be informed that you can request a manual review of the accuracy of an automated decision in case you are not satisfied with it and you have the right not to be subject to a decision based solely on such automated processing.



How do we protect your Personal Data?

 

We have taken a number of security measures to guarantee the safety of your Personal Data. We adopt appropriate data collection, storage and processing practices, and security measures for protection against unauthorized access, loss, misuse, accidental or unlawful destruction, modification, disclosure, unauthorized access or any other unlawful handling. We take all appropriate measures to ensure you’re your Personal Data is handled securely.

The Company and any third-party service providers that may engage in the processing of Personal Data on our behalf (for the purposes indicated above) are also contractually obligated to respect the confidentiality of the Personal Data.



Retention of your Personal Data

 

The length of time we retain your Personal Data is determined by a number of factors including the purpose for which we use that information and our obligations under other laws. It means that we will keep your Personal Data for as long as it is needed for the purposes for which your data was collected and processed but no longer than it is required by the applicable laws and regulations.

The Company will store your Personal Data for as long as it is necessary for providing services and as required by retention requirements in laws and regulations. If the legislation of the Republic of Lithuania does not provide any period of retention of Personal Data, this period shall be determined by us, taking into account the legitimate purpose of the data retention, the legal basis and the principles of lawful processing of Personal Data.

The terms of data retention of the Personal Data for the purposes of the processing of the Personal Data as defined in this Privacy Policy are following:

  1. we retain your Personal Data as long as your consent remains in force, if there are no other legal requirements which shall be fulfilled concerning Personal Data’s processing;
  2. in case of the conclusion and execution of contracts – we retain your Personal data until the contract concluded between you and us remains in force and up to 10 years after the contractual relationship between you and us has ended;
  3. your Personal Data which has been collected in order to fulfill the obligations under the Law on Money Laundering and Terrorist Financing Prevention in a proper way shall be stored in accordance with the provisions of Law on Prevention of Money Laundering and Terrorist Financing of the Republic of Lithuania, mainly – up to 8 (eight) years. The afore-mentioned period may be extended for a period not exceeding 2 (two) years, provided there is a reasoned request from a competent authority;
  4. your Personal Data which has been submitted by you through our website is kept for a period which is necessary for the fulfilment of your request and to maintain further cooperation, but no longer than 6 months after the last day of the communication, in case there are no legal requirements to keep them longer.

In the situations when the terms of data keeping are stated in the legislative regulations, the legislative regulations shall be applied.

Please also be informed that under some circumstances, your Personal Data might be stored longer, mainly:

  1. in case it is necessary in order for us to defend ourselves against claims, demands or action and in order to exercise our rights in a proper way;
  2. in case there is a reasonable suspicion of an unlawful act that is being investigated;
  3. in case your Personal Data is necessary for the proper resolution of a dispute/ complaint;
  4. under other statutory grounds.


What rights do you have in relation to your Personal Data?

 

You as a data subject have a number of rights in relation to your Personal Data. Under certain circumstances and in accordance with EU or other applicable data protection laws, you may have the right to:

1. Right to be informed about the processing of your Personal Data

You have the right to get information about which Personal Data concerning we process. However, this right may be restricted by legislation, protection of other persons’ privacy and consideration for the Company’s business concept and business practices. The Company’s know-how, business secrets as well as internal assessments and material may restrict your right of access.

2. Right to rectification of incorrect or incomplete data

If it turns out that we process Personal Data about you that is inaccurate, you have the right to request a rectification of the Personal Data. You can also request to have incomplete Personal Data about you completed.

3. Right to erasure

You have the right to have any or all of your Personal Data erased. Provided we do not have any continuing lawful reason to continue processing or holding your Personal Data, we will make reasonable efforts to comply with your request. In certain cases, we cannot erase all of your Personal Data. In such case this would be due to the fact that we need to store your Personal Data due to a contractual relationship or law.

4. Right to restriction of processing of your Personal Data

You may also ask us to restrict processing your Personal Data for a period of time. This can pertain, for example, to a situation where you believe it is unlawful for us to do so and/or data about you is inaccurate and we need to verify it. It can also pertain to a situation where you object to processing that we base on a legitimate interest. In such case we must verify if our grounds override yours;

5. Right to object to any use of your Personal Data which is based on the legitimate interests

Where we rely on our legitimate interests as the legal basis for processing your Personal Data, you have the right to object to us using your Personal Data, unless our reasons for undertaking that processing outweigh any prejudice to your data protection rights.

6. Right to Personal Data portability

In certain situations you can ask us to transfer your Personal Data to another data controller or provide directly to you in a convenient format (NOTE: applicable to Personal Data which is provided by you and which is processed by automated means on the basis of consent or on the basis of conclusion and performance of the contract).

7. Right to withdraw your consent

In certain situations, where we rely on your consent as the legal basis for processing your Personal Data, you may withdraw your consent at any time. In case you withdraw your consent, we will stop that particular processing, when the processing is based on such consent. However, if you withdraw your consent, our use of your Personal Data before you withdraw remains lawful;

8. Right to lodge a complaint with a supervisory authority

You have the right to file a complaint concerning our processing of your Personal Data in the same manner as stated below in Section “Implementation of Your right” of this Privacy Policy. All queries and complaints shall be handled in a timely manner by us in accordance with internal procedures.

In case you consider that our processing of your Personal Data is processed in a way that violates your rights and legitimate interests stipulated by applicable legislation, you may also lodge a complaint with a supervisory authority – the State Data Protection Inspectorate.



Implementation of Your rights

 

We will exercise the above-mentioned rights only after we receive your written request to exercise a particular right indicated above and only after confirming the validity of your identity. Such written request shall be submitted to us by personally appearing at our registered office address, by ordinary mail or by e-mail: [email protected].

Your requests shall be fulfilled or fulfilment of your requests shall be refused by specifying the reasons for such refusal within 30 (thirty) calendar days from the date of submission of the request meeting our internal rules and GDPR. The afore-mentioned time frame may be extended for 30 (thirty) calendar days by giving a prior notice to you if the request is related to a great scope of Personal Data or other simultaneously examined requests. A response to you will be provided in a form of your choosing as the requester.

What is Paysend Global Transfer?


Paysend Global Transfer is an electronic money institution supervised by the Bank of Communications () located at Hong Kong.

By obtaining Paysend Global Transfer membership and using Paysend Global Transfer, you may be eligible to:

  • Exchange money in different currencies

You will be charged a subscription fee based on the pricing plan you choose. The subscription fee may be charged monthly, quarterly or annually, depending on your subscription model. The pricing plans and what they include, as well as any additional fees which may apply can be found on the pricing page. You may be charged an additional fee for services not covered by your monthly subscription or services you have used more than your monthly free allowance.

Additional fees will always be shown on your Paysend Global Transfer app before you approve the relevant action. You also have the option to unsubscribe from a pricing plan by contacting Paysend Global Transfer or by using the “unsubscribe” button on the Paysend Global Transfer mobile app. If you unsubscribe, you will not get any monthly free allowance for the services that are subject to a charge. In this case, you will be charged for all services based on the pricing you receive. If you remain unsubscribed for 3 months, your account may be suspended or terminated by Paysend Global Transfer without sending an additional notice in advance.

The monthly subscription fees and other charges will be deducted from your accounts automatically. We may deduct due fees or charges from your accounts in currencies other than EUR. In this case, the exchange rate that is applicable at the time of the deduction will be used. If none of your accounts have sufficient funds to cover the charges, we have the right to deduct these charges from your future Paysend Global Transfer Account balance, change your subscription plan to the free plan, enforce payment through debt collection and pursue other legal remedies.

You will be charged a subscription fee based on the pricing plan you choose. The subscription fee may be charged monthly, quarterly or annually, depending on your subscription model. The pricing plans and what they include, as well as any additional fees which may apply, can be found on the pricing page.

Additional fees will always be shown on your Paysend Global Transfer app before you approve the relevant action. You also have the option to unsubscribe from a pricing plan by contacting Paysend Global Transfer or by using the “unsubscribe” button on the Paysend Global Transfer mobile app.

If you remain unsubscribed for 3 months, your account may be suspended or terminated by Paysend Global Transfer without sending an additional notice in advance.

The monthly subscription fees and other charges will be deducted from your accounts automatically. We may deduct due fees or charges from your accounts in currencies other than EUR. If none of your accounts have sufficient funds to cover the charges, we have the right to deduct these charges from your future Paysend Global Transfer Account balance, change your subscription plan to the free plan, enforce payment through debt collection, and pursue other legal remedies.

How to achieve Paysend Global Transfer?

In order to use our services, you have to register and open a Paysend Global Transfer Account. You can only have one Paysend Global Transfer Account at a time.

Requirements to apply for a Paysend Global Transfer Account:

  • Be 18 years old or over

When you apply to open an account, we will need to confirm your identity. We do this by automatically checking a photo of your valid identity card, driver’s license, passport, or residence card and matching that with a photo of your face.

If you have legitimate reasons for being unable to provide the requested identity documents, contact us by sending an e-mail to [email protected].

3. How to achieve Paysend Global Transfer?

In order to use our services, you have to register and open a Paysend Global Transfer Account. You can only have one Paysend Global Transfer Account at a time.

There are only two requirements to apply for a Paysend Global Transfer Account:

  • Be 18 years old or over
  • Be the resident of a country other than those listed here

When you apply to open an account, we will need to confirm your identity. We do this by automatically checking a photo of your valid identity card, driver’s license, passport, or residence card and matching that with a photo of your face. We may not be able to accept certain documents as proof of ID, depending on the country where it was issued. You will be informed about which documents can be accepted during your application process.

If you believe that you have legitimate reasons for being unable to provide the requested identity documents, you may contact us by sending us an e-mail at [email protected]. In this case, you should explain in your e-mail the reasons for not being able to provide the identity documentation that is required during onboarding. Our onboarding team will consider the special conditions applicable to your case and if we consider that you have credible and legitimate reasons, we will provide you with alternative ways to verify your identity. In such cases, you may be given additional time to provide the traditional forms of identity documentation, and certain restrictions and limitations may apply to your usage of our services until you do so.

We may also ask you to send us additional copies or scans of certain documents before or after you are registered for a Paysend Global Transfer Account. Please check our Privacy Policy to find out more about how we collect and process your information and what we do with it.

If you are using our services through Paysend Global Transfer's business partners which have your confirmed identity details, you may be required to perform face verification when you log in through the Paysend Global Transfer mobile app. Doing so will allow you to benefit from the full range of our services that are available to you and you will begin to be charged the monthly subscription fee based on your subscription model, starting from that date.

The documents that you provide must be legible and visible, without any damage, cover, hidden data, or signs of modification. If a document you have provided to Paysend Global Transfer expires, you must supply Paysend Global Transfer with a new and valid version of that document.

We may refuse your application to register if we have significant reasons for it. Even though we always document the reasons for such refusal, we are not obliged to reveal them to you due to regulatory requirements.

By registering, you confirm that the data provided during the registration process is up-to-date and correct. If any of the information you provide us during registration changes after your account is created, you should notify us as soon as possible.

4. Paysend Global Transfer Account and App

Our main service is Paysend Global Transfer Account, which is a payment account created for all users following registration.

When you receive money in your Paysend Global Transfer Account, Paysend Global Transfer issues electronic money in the same value for you. You can hold electronic money in your Paysend Global Transfer Account and use the Paysend Global Transfer Account for other payment services which will be described below. You will be able to hold funds in different currencies we offer. Here is the current list of available currencies.

By using the Paysend Global Transfer App, you can make use of a variety of our services, subject to your eligibility for them. These include the ability to:

  • Access your Paysend Global Transfer Account
  • Transfer funds to other accounts
  • Exchange currencies
  • Check your balance and transaction history
  • Change your phone number or address
  • Order a Paysend Global Transfer Card or change its delivery address

The Paysend Global Transfer App is available via Google Play, Huawei App Gallery, or Apple App Store.

5. Paysend Global Transfer Transactions

Whenever you send or receive money, exchange currencies, or use your Paysend Global Transfer Card to make a payment, you are making a transaction.

As a financial institution, we are obliged to check each transaction and do our best to ensure that:

  • None of the transactions occurring through Paysend Global Transfer are fraudulent, illegal, unauthorized, or against anti-money laundering or terrorist financing regulations.
  • The source of the funds involved, or the underlying legal reasons for the transactions, are clear and not suspicious.
  • The amount, number, or frequency of the transactions are not suspicious, taking your spending pattern as well as other circumstances into consideration.

We may ask you to provide additional information or documentation relating to your transactions if we consider it necessary to ensure that your transactions comply with the above criteria.

If Paysend Global Transfer reasonably suspects any issues, your transaction may be delayed or refused. In such cases, we may also suspend your access to part or all of our services. As long as we are legally and technically able to do so, we will inform you about the refusal of your transaction and the underlying reasons as soon as possible.

We also reserve the right to reverse a transaction that has already been processed if there has been a mistake or technical error in the fundamentals of the transaction order, such as the amount, exchange rate, recipient, limits, etc.

Paysend Global Transfer may use intermediary institutions to provide transaction services, such as top-ups or fund transfers. Paysend Global Transfer is not liable for any delays or errors resulting from technical issues or malfunctions on the intermediaries' side.

Your ability to make transactions may be restricted or suspended due to our responsibility to mitigate money laundering or terrorist financing risks, where permitted under applicable laws and regulations. These restrictions may include limits on the amount, type, or number of transactions or transactions to and from certain countries.

If we determine, or have reasonable grounds to believe, that you are misusing or unfairly exploiting benefits or promotional offers—whether provided by Paysend Global Transfer or third parties—through the use of our services or products, we may restrict your access to certain services. These measures may be necessary to protect Paysend Global Transfer and its customers from adverse outcomes, such as increased operational costs or transaction limitations imposed by other financial institutions.

Paysend Global Transfer keeps records of all your transactions. You can view them and download statements of your account movements using the Paysend Global Transfer App.

(a) Adding Funds (Top-Up)

You can top-up your Paysend Global Transfer Account using the Paysend Global Transfer app in any of the numerous currencies offered. There are several top-up methods available. Top-up is free up to the limit specified in your subscription plan. The top-up fee (if any) will be displayed in the app when you are making the transaction.

You can top-up your account only with a payment instrument (for example, a card) issued under your name.

You can also receive funds from outside of Paysend Global Transfer by using the IBAN corresponding to your account in the desired currency. Such transactions are not counted towards your free top-up limit.

Paysend Global Transfer strives to always comply with applicable laws and regulations as well as orders, decisions, and rulings received from law enforcement agencies, prosecutors, supervisory institutions, or courts. At times, this may lead to Paysend Global Transfer blocking or transferring funds without your explicit consent. In such instances, we will inform you about the underlying reasons, to the extent permissible by relevant applicable laws and regulations.

(b) Transferring Funds

You can transfer funds locally or internationally from your Paysend Global Transfer Accounts by using several methods, including SEPA and SWIFT. You can choose to cover the transfer fees or split the fees with the recipient.

Please be careful when entering the transaction amount or the recipient details and make sure the recipient is trustworthy. You are responsible for ensuring that the transaction details are accurate. If the transaction details are inaccurate or insufficient, the transaction may fail. If you change your mind about the transaction after a transfer is settled to the recipient’s bank, you may not be able to revoke the transfer and retrieve your funds from the recipient.

If you make the transfer in Euro to an account in a country within the European Union, your transfer will be settled no later than the end of the next business day. Other transfers within the European Union will be settled to the recipient’s bank in less than 4 business days. The settlement time for other transfers will depend on various factors, including processing times or intermediary banks and additional regulatory checks. Transfer orders received outside of working hours (08:00 – 16:00 CET/CEST) on business days or outside of business days are considered to be received at 08:00 AM CET on the next business day.

If you make a transfer to a country outside of the SWIFT system, additional charges applied by correspondent or recipient banks may be incurred, which cannot be known prior to making the transfer. In these cases, you will be asked to bear the additional costs.

You will not be able to transfer funds from your account if the usable balance of that account is not sufficient to complete the transfer.

(c) Paysend Global Transfer Buddies

Paysend Global Transfer Buddies is another method of transferring funds that allows you to make transfers to other Paysend Global Transfer users using a phone number, without knowing their actual account number.

If the recipient is also a Paysend Global Transfer user, the transfer will be settled on the recipient’s account instantly. In case the recipient is not a Paysend Global Transfer user, an SMS invitation will be sent to the phone number you provide. The recipient will be able to access the funds by registering for a Paysend Global Transfer Account.

(d) Making Payments

You can easily make payments with your Paysend Global Transfer Card at any point of sale or on the internet. You can also use Paysend Global Transfer Pay for your online purchases if the method is accepted by the seller.

Paying with Paysend Global Transfer Card or Paysend Global Transfer Pay is not subject to any additional fees or charges unless you are prompted before you approve the transaction that additional third-party charges will apply.

In some online stores, you may encounter Paysend Global Transfer Pay, our payment method that works with a Paysend Global Transfer QR code. To use this payment method, you just need to scan the code with your phone camera or use the special function in the Paysend Global Transfer App. Paysend Global Transfer Pay allows transactions to be made immediately after approval.

(e) Exchanging Currencies

You can exchange currencies at attractive exchange rates. Choose between the currencies available on your account. Currency exchange is instantaneous as long as you have sufficient funds at the time of the transaction.

If you do not have sufficient funds to cover the transaction or payment amount in the account that you choose, Paysend Global Transfer will automatically exchange and withdraw the necessary amount from your other currency accounts in the following order: EUR, USD, GBP, PLN, HKD.

6. Negative Balance

Your Paysend Global Transfer Account may have a negative balance due to reasons such as Paysend Global Transfer Card transactions, waived cashbacks, charges and fees, error corrections, waived chargeback refunds, or other amounts you may incur pursuant to these terms. Any negative balance is covered automatically from your other accounts (please see the “Exchanging Currencies” section above) or the future top-ups to your accounts. In the absence of sufficient funds in your other Paysend Global Transfer accounts to cover the negative balance, such negative balance is an unauthorized debt owed to Paysend Global Transfer LLC.

You must repay such debt in full within 5 days from the moment of its occurrence. If an amount sufficient to cover the outstanding balance is not deposited into your respective Paysend Global Transfer account within the specified period, you will be charged interest at the rate of 0.5 percent of the outstanding balance for each day of delay, or the maximum interest rate permitted by law.

In connection with the occurrence of a debt, you must indemnify Paysend Global Transfer LLC for the losses and damages incurred in full, as well as all actual costs incurred by Paysend Global Transfer to collect this debt, including but not limited to:

  • Costs of legal aid
  • Costs of legal services
  • Costs of document translations
  • Costs of notarization of necessary documents
  • Costs of conducting necessary examinations
  • Court fees
  • Necessary state duties and other necessary expenses

Accordingly, if you do not pay your negative balance within 5 days, Paysend Global Transfer has the right to initiate debt recovery processes, apply to the courts, or otherwise request injunction or interim relief for the purpose of recovering any unpaid negative balance. If we send you a demand letter for overdue payments, you will be charged an additional fee based on your address (6,82 PLN for Poland; 20 PLN for other countries).

If you have both an individual and a business account (as a sole trader) with Paysend Global Transfer, you give us permission to cover negative balances and other due receivables of your business account from your individual account.

7. How to keep Paysend Global Transfer secure

You must keep all login credentials, passwords, passcodes, Paysend Global Transfer Cards, PINs, payment instruments, or the devices/mobile numbers identified with Paysend Global Transfer and any other means of authentication safe from theft or unauthorized access by other people.

You must keep all your software on all electronic devices that are being used to benefit from Paysend Global Transfer services up to date to ensure the security of the devices and the networks being used (e.g., antivirus software and firewalls).

Contact our Paysend Global Transfer User Support immediately via [email protected] if you suspect that any login credentials, passwords, Paysend Global Transfer Cards, or the devices/mobile numbers identified with Paysend Global Transfer are lost, stolen, misappropriated, or otherwise breached by unauthorized third parties.

8. What if Paysend Global Transfer is disturbed?

You can reach us and report your claim or complaint via chat in the app, email at [email protected], or by choosing a transaction in your Paysend Global Transfer app and pressing the HELP and "Get Refund” buttons.

When you contact us via e-mail, please send your message from the same e-mail address you have provided to Paysend Global Transfer. If this is not possible, please let us know, and we will try to solve this issue by asking you to provide additional verification to clarify your identity.

Languages we use for claims/complaints communication: English, Polish, and/or the official language of your country of residence, unless otherwise agreed.

When you contact us, please provide as much information as possible regarding your complaint or claim.

(a) I did not authorize this transaction

If you have acted according to the “How to keep Paysend Global Transfer secure” section above, but you still suspect that a transaction was made from your Paysend Global Transfer Account without your authorization, you have 13 months from the date of the transaction to inform us and receive a refund. Unless we find that you have acted fraudulently or you have not complied with your security obligations mentioned above, we will refund the transaction back to your account by the end of the next business day.

(b) I have a problem with my Paysend Global Transfer Card payment

i. I have authorized the payment with my Paysend Global Transfer Card, but the amount of the payment was not specified at the time, and it was more than what I reasonably could have expected.

If the recipient of your payment is located in the EEA, you can request a refund for the aforementioned payments within 8 weeks from the date of the payment. Once you provide us with all the relevant documents and information which proves these points, we will refund you the full amount within 10 business days.

ii. Paysend Global Transfer CARE: I have another problem with my Paysend Global Transfer Card payment or the service/product I have purchased

Paysend Global Transfer offers a special customer care service called Paysend Global Transfer Care. Whenever you use your Paysend Global Transfer Card to pay for goods or services and you are not satisfied with the product or the service you receive, you can contact Paysend Global Transfer Care instead of the merchant. We will contact the merchant on your behalf and try to resolve your issues directly with them.

By applying to Paysend Global Transfer Care, you grant us your permission to contact the merchant on your behalf for the resolution of your dispute with them. For that purpose, if necessary, we may ask you to execute a written power of attorney.

9. Losing Paysend Global Transfer

(a) Suspension of your Paysend Global Transfer Account

If you do not make any successful transaction using your Paysend Global Transfer Account or your Paysend Global Transfer Card for 6 consecutive months, we may suspend your Paysend Global Transfer Account for security purposes. In order to reactivate your account, contact us and provide us with up-to-date documents that would allow us to reactivate your account. During the suspension period, you will not be charged for the services which have been suspended.

We may also suspend whole or part of our services immediately if we reasonably suspect or determine that:

  • You repetitively or persistently breach Paysend Global Transfer terms that are applicable to you;
  • You provided us with false or misleading information or documentation, or you failed to keep us up-to-date with your personal or contact data, or failed to provide us with the documents and/or information we requested in relation to the periodical review of your personal data and/or your conducted payment transactions within the indicated timeframe;
  • You used or may use Paysend Global Transfer services for criminal activities, or you have violated applicable laws or regulations, especially regarding AML/CTF regulations;
  • You used or may use Paysend Global Transfer services for malicious, illegal, or immoral purposes, or in a way which may harm Paysend Global Transfer, Paysend Global Transfer employees, or Paysend Global Transfer business partners’ reputation or business, or you are abusing Paysend Global Transfer’s system, or you are in material breach of your obligations under these, or any other terms of Paysend Global Transfer agreed by you;
  • You used external tools that were designed to manipulate data or influence the flow of money in order to avoid liabilities or gain unfair, fraudulent, or illegal advantages or other such benefits;
  • You failed to pay any fees, or you failed to pay any other financial obligation to us in a timely manner for 2 months in a row;
  • Your actions may cause undue harm to the reputation of Paysend Global Transfer, or cause undue losses or monetary sanctions to Paysend Global Transfer;
  • You are no longer resident in one of the countries eligible for creating a Paysend Global Transfer account;
  • You have duplicate Paysend Global Transfer memberships;
  • You are using the services to send payments to or receive payments from, or in connection with a transaction related to a country on the prohibited jurisdictions list;
  • You are using the services for activities related to those provided on the prohibited activities list;
  • You use the individual account to perform business activities (in such a case we can ask you to apply for a business account);
  • You abuse Paysend Global Transfer’s services (e.g., you have ordered an unreasonable amount of Paysend Global Transfer Cards or made an unreasonable number of transactions in a short period of time);
  • Paysend Global Transfer becomes aware of your death, loss of legal capacity, bankruptcy, or insolvency;
  • Paysend Global Transfer receives a legal notification regarding a freezing order on your assets or another injunction has been claimed by a third party;
  • The security of your Paysend Global Transfer app or Paysend Global Transfer Card was breached, your login credentials have been disclosed to third parties, or your funds need to be protected.

In case the services are suspended due to reasons connected with points (iii) and (vi) above, the suspension is given for a period of 30 days, with the right to extend it for an unlimited number of times until the funds in question are fully reverted or the suspicion has been cleared.

We use the suspension period to investigate the matter and to communicate with you. During this time, we may decide if we want to end the suspension with or without certain conditions, or we may decide to terminate our agreement.

(b) Termination of your Paysend Global Transfer Account

We conclude the agreement for an indefinite period. It applies until it is terminated by you or us.

You can terminate your agreement at any time, with one month's notice effective at the end of the month. You can send us your request for termination via the chat function, the “close account” button in the Paysend Global Transfer app, or by sending us an email from the address you have registered with Paysend Global Transfer to [email protected]. When you contact us for termination, you should provide us with account details to transfer any funds that may remain in your account at the day of termination.

If we terminate your agreement, we will notify you 60 days in advance.

We may terminate the agreement immediately if we reasonably suspect or determine that:

  • You repetitively or persistently breach Paysend Global Transfer terms that are applicable to you;
  • You provided us with false or misleading information or documentation, or you failed to keep us up-to-date with your personal or contact data, or failed to provide us with the documents and/or information we requested in relation to the periodical review of your personal data and/or your conducted payment transactions within the indicated timeframe;
  • You used Paysend Global Transfer services for criminal activities, or you have violated applicable laws or regulations, especially regarding AML/CTF regulations;
  • You used Paysend Global Transfer services for malicious, fraudulent, illegal, or immoral purposes, or in a way which may harm Paysend Global Transfer, Paysend Global Transfer employees, or Paysend Global Transfer business partners’ reputation or business, or you are abusing Paysend Global Transfer’s system, or you are in material breach of your obligations under these, or any other terms of Paysend Global Transfer agreed by you;
  • You used external tools that were designed to manipulate data or influence the flow of money in order to avoid liabilities or gain unfair, fraudulent, or illegal advantages or other such benefits;
  • You are no longer resident in one of the countries eligible for creating a Paysend Global Transfer account;
  • You have duplicate Paysend Global Transfer memberships;
  • You are using the services to send payments to or receive payments from, or in connection with a transaction related to a country on the prohibited jurisdictions list;
  • You are using the services for activities related to those provided on the prohibited activities list;
  • You abuse Paysend Global Transfer’s services (e.g., you have ordered an unreasonable number of Paysend Global Transfer Cards or made an unreasonable number of transactions in a short period of time);
  • Paysend Global Transfer becomes aware of your death, loss of legal capacity, bankruptcy, or insolvency;
  • Paysend Global Transfer is required under applicable laws and regulations to terminate its relations with you;
  • Your Paysend Global Transfer membership remains suspended for more than 6 months.

We will specify the reasons for terminating your account. However, if your account has been terminated for reasons connected to points (iii) or (iv) above, Paysend Global Transfer may not be able to indicate the reasons for termination due to regulatory restrictions applicable to Paysend Global Transfer.

If you have funds remaining in your Paysend Global Transfer account at the moment of termination, we will return them to another account provided by you. In cases of termination based on points (iii) or (iv) above, Paysend Global Transfer can return the funds to your own account held at another financial institution. Where possible, we will return the remaining funds to you in the same currency of the relevant Paysend Global Transfer account. In other cases, where a refund in your account’s currency is not possible, we will convert your funds to EUR and transfer them via an available channel.

Standard transfer fees will be applied for this refund operation. You may be charged an additional manual operation fee in case the transfer of the remaining funds requires manual input, such as currency conversion or initiation of the refund operation. If the account balance does not cover the transaction fees, Paysend Global Transfer may request the settlement of unpaid amounts separately.

In case it is not possible to return the remaining funds due to circumstances independent of Paysend Global Transfer or if the owner of the funds is not known, Paysend Global Transfer may book the funds on a technical account until the entitled party duly requests their return.

When possible, we will notify you why we are suspending or terminating our cooperation as soon as we can.

Unless you opted out of receiving such emails, you will receive the breakdown of all transactions completed using Paysend Global Transfer services, up to 36 months before the date of termination. We may refuse to provide such information if we have grounds to believe that access to the Paysend Global Transfer account was unauthorized or fraudulent.

10. Legal Liability

If we incur any losses or damages (including but not limited to fines from international payment card organizations, other financial institutions, or supervisory bodies) resulting from your breach of these terms or applicable laws and regulations, we may reflect these amounts to you or freeze the relevant portion of your funds until the dispute is resolved. We may also follow debt recovery processes or other legal remedies for the recovery of such amounts.

The grounds for termination listed under subsections 9.b.ii, 9.b.iii, 9.b.iv, 9.b.v, 9.b.vii, 9.b.viii, 9.b.ix, 9.b.x are considered, among others, as material breaches of this contract.

We have the right to withhold the portion of the funds that are subject to an unresolved dispute between you and us or an investigation relating to AML/CTF or similar issues under the applicable laws, until such dispute or investigation is resolved.

If you have funds in your Paysend Global Transfer account that were transferred due to an error, or abuse of Paysend Global Transfer's system, or illegal activities, or have any unpaid fees or commissions, applicable fines, losses, or damages incurred by us due to your breach of these terms, other Paysend Global Transfer terms applicable to you, agreements between you and Paysend Global Transfer, or any applicable laws, we are entitled to unilaterally deduct such funds from your Paysend Global Transfer account.

We disclaim all liability for indirect or consequential damages or losses or for force majeure events which are beyond our reasonable control.

We are not responsible for any loss or damage you may incur as a result of the termination or suspension of Paysend Global Transfer’s services pursuant to these terms.

11. Paysend Global Transfer Communication

We will communicate with you via the Paysend Global Transfer App or via the email address, residence address, or phone number you provided us. For security purposes, the Paysend Global Transfer App is always the primary method of communication.

By using our services, you agree and acknowledge that Paysend Global Transfer or its agents may serve legal notices, including demand letters, or letters connected to court or bailiff proceedings (collectively referred to as "Legal Notices") upon you by email. Legal Notices served by email shall be deemed received and effective on the date of transmission, provided that the sender does not receive an undelivered or similar error message. The email address you have registered with Paysend Global Transfer is deemed to be the valid delivery address.

You are responsible for keeping your email address up to date and notifying Paysend Global Transfer without delay in the event of a change in the address.

12. Changes in Paysend Global Transfer Terms

If we make any changes to these terms, we will notify you by email or push notification on the Paysend Global Transfer App 60 days in advance. Changes to these terms may be made without prior notice to you and shall be effective immediately, only if they are required by law, relate to the addition of a new Paysend Global Transfer service, introduce extra functionality to an existing Paysend Global Transfer service, reduce the fees applicable to Paysend Global Transfer services, or involve style or grammar corrections, or the changes do not reduce or limit your rights, increase your liability, or create an adverse effect on you.

Furthermore, if we need to make changes in the fees or commissions due to an increase in our costs or due to inflation, the changes we make in the applicable fees or fee plans may be effective immediately.

You may accept or reject proposed changes to these Paysend Global Transfer terms before they come into effect. If you agree with the changes, no further action is required, and the changes will take effect on the date specified.

If you notify us of your disagreement with the proposed changes, it will be deemed a notice that you wish to terminate these terms on the date the changes are set to take effect, unless you provide another date in accordance with these terms.

13. Paysend Global Transfer Privacy We process your personal data mainly for the purpose of performing the service and fulfilling obligations resulting from legal provisions. Details on the purposes of processing, the rules we apply, and your rights can be found in our Privacy Policy. 14. Final Provisions The entire text of these Paysend Global Transfer terms, as well as any documents derived from it, has been written in English. These Paysend Global Transfer terms may be translated into other languages; however, in the event of any discrepancy between the original text and the translated versions, the English version shall prevail. You confirm that you possess the legal capacity required under the applicable law for the execution of these terms. Paysend Global Transfer shall, in all cases, act as an independent party and does not control or assume responsibility for the products and services paid for using Paysend Global Transfer services. Paysend Global Transfer shall not be responsible for the performance of any transaction entered into between the purchaser, seller, or any other party and you, unless otherwise stated in separate agreements between you and Paysend Global Transfer. You shall not have the right to assign your rights and obligations arising from these terms to third parties without Paysend Global Transfer's prior written consent. Paysend Global Transfer reserves the right to assign its rights and obligations under these terms to third parties at any time without your consent, provided that such assignment does not conflict with the law. If any provision of these terms is found to be invalid, this shall not affect the validity of the remaining provisions or other agreements between you and Paysend Global Transfer. These Paysend Global Transfer terms shall be published on Paysend Global Transfer’s website in English and any other languages if translated
